All href values are \"#\" placeholders.\n     ============================================================ -->\n<div style=\"background:#F3F7FD;border-left:4px solid #305EA8;border-radius:8px;padding:20px;margin-bottom:28px;\">\n<p style=\"margin:0;\">In 2025, Polish grid operators issued <strong>4,897<\/strong> connection refusals covering a record <strong>107 GW<\/strong> of capacity, against 73.6 GW the year before. The count of refusals actually fell, down from 7,817 in 2024. Fewer applications were turned away and each one carried far more megawatts, which is what happens when the projects reaching the front of the queue get larger. A 15 MW factory is now in that size bracket.<\/p>\n<\/div>\n\n<p>Most of that refused volume is generation. The capacity arithmetic behind it makes no distinction between a solar farm asking to export and a plant asking to draw 15 MW from the same overloaded main power supply point (GPZ), and 2,133 of those refusals were issued for lack of technical conditions rather than economic ones. A site-selection team that models land cost, labour pool, logistics and special economic zone incentives to the decimal, then treats grid capacity as something the utility confirms after a term sheet is signed, has left the one variable most likely to move the schedule by a year sitting outside the model.<\/p>\n\n<p>On 30 April 2026 the most significant change to the Polish connection procedure in years came into force. Scarcity did not move. What UC84 changed is what an investor commits in cash before knowing the answer, how long the terms stay valid once granted, and what an industrial consumer can do with capacity already held.<\/p>\n\n<h2>What a plant now budgets for at application stage?<\/h2>\n\n<p>The Act of 13 March 2026 amending Prawo energetyczne, known in the industry by its legislative number UC84, applies to connections above 1 kV. Low voltage is unaffected, which is academic for industrial load, since a plant drawing more than a few hundred kW connects at medium or high voltage anyway.<\/p>\n\n<div style=\"background:#FFFFFF;border:1px solid #D7E3F8;border-radius:8px;padding:20px;margin:24px 0;\">\n<h3 style=\"margin-top:0;\">Cash committed before anyone confirms the answer<\/h3>\n<ul>\n<li><strong>Application fee<\/strong>, new under UC84: 1 PLN per kW of connection capacity applied for, capped at 100 thousand PLN, payable separately for each connection point and non-refundable regardless of outcome.<\/li>\n<li><strong>Advance payment (zaliczka)<\/strong>: doubled from 30 to 60 PLN per kW of connection capacity, capped at 6 million PLN. Where the applicant already holds connection capacity, it applies only to the increment.<\/li>\n<li><strong>Financial security (zabezpieczenie)<\/strong>: 30 PLN per kW up to 100 MW and 60 PLN per kW above that, capped at 12 million PLN, and it has to be lodged within 14 days of signing the connection agreement or the agreement expires by operation of law.<\/li>\n<li><strong>Validity of connection conditions (warunki przy\u0142\u0105czenia)<\/strong>: 12 months for the electricity grid, halved from 24. The window between holding terms and holding a signed connection agreement is now one year.<\/li>\n<li><strong>Building permit deadline<\/strong>: the connection agreement expires by operation of law if the operator is not notified of a final building permit in time. For receiving equipment that threshold is 24 months covering at least 50 percent of the capacity, and where the equipment sits inside a building, it is the building permit for that building that counts.<\/li>\n<\/ul>\n<p style=\"margin-bottom:0;\">That last point is the one site-selection teams miss most often, because published summaries of UC84 tend to list the 24-month and 36-month deadlines for photovoltaic installations (PV), battery energy storage systems (BESS), wind and biogas and stop there. Industrial load has its own line in the same provision.<\/p>\n<\/div>\n\n<h2>Capacity you already hold is worth more than it was in April<\/h2>\n\n<p>The same package extended cable pooling beyond renewable installations to cover storage and generating technologies of any kind. For a plant on a connection that is already tight, an on-site battery sized to shave peaks can often be structured inside capacity already granted, which sidesteps a network reinforcement that could take years and might never be built.<\/p>\n\n<p>The mechanism differs depending on what already stands on the site, and the distinction is worth getting right before it goes into a term sheet. A plant with its own PV installation adds the battery under the amended Article 7(1f) and pays no advance, provided existing connection capacity does not increase. A plant with no generation of its own relies on Article 7(8a), where an applicant already holding connection capacity pays the advance on the increment only, so with no increment there is nothing to calculate. Either way the application for connection conditions still gets filed and the operator still reviews it. What changes is the cost of entry.<\/p>\n\n<p>One further provision rewards keeping capacity flat. Where connection conditions already exist and connection capacity for both consumption and generation stays unchanged, the grid impact study under Article 7(8e) drops the load flow analysis and covers only whether the network can maintain its working parameters. A narrower study is a shorter study.<\/p>\n\n<p>Worth knowing alongside it: that study is not required at all for end consumers with connection capacity at or below <strong>5 MW<\/strong>, or for generating units and storage with total installed capacity at or below 2 MW. A project sitting at 5.5 MW and a project sitting at 4.9 MW are on different timelines for reasons that have nothing to do with the plant itself.<\/p>\n\n<h2>The interpretive gap, and where it now stands<\/h2>\n\n<p>The rules on advances, security and deadlines carry their own six month vacatio legis for projects already in the connection pipeline before UC84 passed, running to <strong>15 October 2026<\/strong>. For those projects that date is when the protections switch on, months after most people assume they already had them.<\/p>\n\n<p>On <strong>31 July 2026<\/strong> the Sejm passed the corrective amendment prepared through the Deregulation Committee chaired by Ryszard Petru, by 250 votes to none with 192 abstentions. It replaces the ambiguous cross references in the transitional provisions with specific dates covering when connection conditions were obtained, when the connection agreement was signed, and how the deadline for delivering final building permits is calculated. The Senate and the President&#8217;s signature are still ahead of it. Until publication, operators continue working to their own readings, and those readings have not been consistent with each other.<\/p>\n\n<p>For a developer that inconsistency is an annoyance. For a factory owner it sits on the critical path between signing a plot and starting construction. On a 15 MW plant, a year lost to a misread connection point shows up as carrying cost on the land option, a delayed production ramp and, in the worst case, a land deal renegotiated from a weaker position.<\/p>\n\n<div style=\"background:#FFFFFF;border:1px solid #D7E3F8;border-radius:8px;padding:20px;margin:24px 0;\">\n<h3 style=\"margin-top:0;\">One more date to put in the schedule<\/h3>\n<p style=\"margin-bottom:0;\">Where an existing connection agreement sets a connection date later than three years from 30 April 2026, security equal to one quarter of the amount has to be lodged within six months of the amendment taking effect, meaning by <strong>30 October 2026<\/strong>, failing which the agreement expires by operation of law. If the project you are acquiring comes with a connection agreement attached, that date belongs in the diligence checklist rather than in the surprises column.<\/p>\n<\/div>\n\n<h2>How Poland reads against Germany and the Netherlands?<\/h2>\n\n<p>Teams benchmarking Poland against Western Europe are often benchmarking against a picture that is several years out of date. Both of the obvious alternatives carry queues of their own.<\/p>\n\n<p>Germany replaced first-come-first-served allocation at transmission level with a maturity-based procedure, the Reifegradverfahren, from 1 April 2026. The reason was volume: at the end of Q3 2025 the four transmission operators held 717 connection requests totalling roughly <strong>270 GW<\/strong>, of which 545 requests and 211 GW were large-scale battery storage. Entry now costs a 50,000 euro application fee per application, with a realisation deposit of 1,500 euros per MW once an offer is accepted, credited later against the construction cost allowance. The procedure runs in cycles of three months for information and application, five months for the cluster study and prioritisation, and two months for offers, so a full cycle is ten months. Projects that miss one cycle stay in the process at no further cost and are reassessed in the next.<\/p>\n\n<p>The Dutch queue is longer and the comparison is stark. TenneT&#8217;s transmission-level waiting list holds 212 requests for offtake totalling <strong>38 GW<\/strong>, against a national peak demand of roughly 19 GW, so the queue that cannot be connected is twice the entire country&#8217;s peak load. Regional operators hold a further 14,044 requests worth about 9 GW. From 1 July 2026 the prioritisation framework extends to small consumers as well as large ones, so the competitive field for a queue slot has widened.<\/p>\n\n<p>Against those two, Poland&#8217;s risk profile is narrower and, more to the point, it is the kind of risk that engineering work removes. The failure mode here is specific: an application priced or scheduled against the wrong reading of a law that is mid-correction, at a substation whose free capacity nobody verified before the land was optioned. Both halves of that are checkable in weeks.<\/p>\n\n<div style=\"background:#FFFFFF;border:1px solid #D7E3F8;border-radius:8px;padding:20px;margin:24px 0;\">\n<h3 style=\"margin-top:0;\">What to establish before the land option is signed<\/h3>\n<ul>\n<li>Free capacity at the specific main power supply point (GPZ) or switching station serving the plot, confirmed in writing by the operator, before the land agreement rather than after.<\/li>\n<li>Full connection cost modelled against the connection capacity the project actually needs: application fee, advance and security together.<\/li>\n<li>Whether the load falls at or below the 5 MW threshold that removes the grid impact study from the schedule altogether.<\/li>\n<li>The 12-month validity clock on connection conditions (warunki przy\u0142\u0105czenia) and the building permit deadline, both built into the EPC programme from day one.<\/li>\n<li>Whether an on-site battery can be structured inside the existing connection point, which is frequently faster than applying for more capacity.<\/li>\n<li>If a connection agreement comes with the site, whether its connection date falls after 30 April 2029 and therefore triggers the 30 October 2026 security deadline.<\/li>\n<\/ul>\n<\/div>\n\n<p>Two questions settle most of this before anyone signs. Has the operator confirmed free capacity in writing for this exact connection point, and does the EPC programme already assume the 12 month validity window rather than the old 24 month one. Answering either one properly needs somebody who reads a connection point the way the operator&#8217;s technical department reads it.<\/p>\n\n<h2>Where GridLink fits?<\/h2>\n\n<p>We run technical due diligence on grid connections from the owner&#8217;s or investor&#8217;s side, reporting to the people who carry the capital decision. We come back in writing with the capacity realistically available at that point, what the 2026 rules cost to secure it, and where the current divergence between operator readings puts your schedule at risk. <\/p>\n<p style=\"margin-bottom:0;\">If the site comes with an existing connection agreement dated after 30 April 2029, the one quarter security has to be lodged by 30 October 2026 or the agreement lapses by operation of law.
